TERMS OF SERVICE FOR PRIVATE COMMISSIONS
01: GENERAL TERMS
Prices are subject to change based on demand.
I have the right to decline any commission for any reason.
02: PAYMENT
A quote is provided at the start and once approved an invoice will be issued with payment details and instructions.
Payment is charged in GBP and can be paid via bank transfer, PayPal or Swipe.
I require a 30% non refundable deposit to secure your commission booking with the rest due once the final artwork has been approved [please see cancelation policy below for further details]. You are also welcome to pay 100% of the commissions costs upfront should you choose.
03: PROCESS & DELIVERY
The time it takes to finish your commission will vary between 2 weeks - 3 months depending on the medium chosen, complexity of the commission, framing finish, how much work I have on and my general circumstances. I keep all my clients updated throughout the process and can give more specific timeframes on a case by case basis.
For digital paintings: Once finished/approved you will receive the high-resolution image (either JPEG or TIFF) along with a web-friendly size (either JPEG or PNG). If requested, I can also arrange for the professional printing, framing and tracked delivery of the artwork. The cost for this will vary according to your choice of size and finish and the delivery destination. You will also receive a time-lapse, showing the creation of your artwork.
For oil paintings: Once finished/approved your painting will be given a coat of re-touch varnish and once full touch try (usually 1-2 weeks) will be carefully and securely wrapped and boxed and sent to you via tracked delivery service.
04: REVISIONS
During the commission process I will send you updates showing you images of your artwork in progress, where we can discuss any changes that may be needed.
If you wish for me to change something in an artwork you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make.
05: COPYRIGHT & USUAGE
I, Susannah Nathanson (the artist):
I reserve the right to cancel and refund the commission at any time for any reason.
I retain all copyrights over the commissioned artwork.
I retain the right to make reproductions of any artwork created unless the customer has purchased the full rights to the artwork (this is in addition to simply purchasing the original commissioned artwork).
I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.
You (the customer/commissioner):
You may not reproduce the artwork on any website and social channels without prior permission from me.
You have the right to display the artwork in your home or business. Artworks may not be resold or reproduced for profit in any way without the my (the artist’s) written permission.
You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints of it, etc.)
You may NOT alter the commissioned artwork without my (the artist's) consent.
You may NOT use the commissioned artwork for commercial purposes.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially i.e. making money from it in any way not included in these terms.
Claiming the artwork as your own
Altering the artwork without my consent
In some cases, the commercial rights to the image may be purchased.
06: CANCELLATION & REFUND POLICY
Your deposit is non-refundable once work on the commission has started.
If for any reason I am unable to start your commission you will receive a full refund.
If you cancel your order before I have started your commission, you will receive a full refund.
If you are getting a refund through PayPal, do not request a PayPal chargeback. I will transfer the money back to you myself.
If you request a PayPal chargeback at any point when you were not allowed to ask for a refund you will lose all before mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me again.
